General Provisions and Seller Contact Details

These Terms and Conditions (hereinafter referred to as the "Terms") set out the rules and conditions governing the use of the AlessAlicia online store, available at:

The Store is owned and operated by Aleksandra Dziadzio, an artist, with its registered address at:

Technical Requirements

To use the Store, the Customer must have:

  • a computer or another device equipped with a web browser;
  • access to the Internet;
  • an active email address.

Personal Data

The controller of the personal data provided by the Customer while using the Store is the Seller.

The Customer's personal data is processed, in particular, for the following purposes:

  • concluding and performing the sales agreement;
  • processing payments, deliveries, and complaints;
  • fulfilling the Seller's legal obligations, including tax and accounting obligations;
  • establishing, pursuing, or defending legal claims.

Detailed information regarding the processing of personal data, including information about data recipients and the rights of data subjects, is available in the Store's Privacy Policy.

Providing personal data is voluntary; however, it is necessary for the conclusion and performance of the agreement.

The Customer has the right to:

  • access their personal data;
  • rectify inaccurate data;
  • request the erasure of data;
  • request restriction of processing;
  • request data portability;
  • object to processing,

where provided for by applicable law.

The Customer also has the right to lodge a complaint with the President of the Polish Personal Data Protection Office (Urząd Ochrony Danych Osobowych – UODO).


Conclusion of the Sales Agreement and Customer Account

The Store offers both physical goods (the "Goods") and digital content or digital services supplied online (the "Digital Products").

Orders may be placed:

  • without creating an account; or
  • by registering a Customer account in the Store.

In either case, to place an order, the Customer must select the desired Goods and/or Digital Products, add them to the Shopping Cart, and complete the checkout process by selecting the preferred delivery and payment methods.

The descriptions and prices of the Goods and Digital Products displayed in the Store constitute an invitation to enter into a sales agreement within the meaning of Article 71 of the Polish Civil Code and do not constitute an offer.

To place an order, the Customer must complete all mandatory fields in the order form required for shipment and, if requested, for the issuance of a VAT invoice.

If the Customer chooses to create an account (the "Account"), registration is completed only once. The Customer's email address and chosen password will subsequently be used to log in. The Store also allows Customers to log in using selected social media accounts and/or a Google account.

After logging into the Account, the Customer has access to their order history and is not required to enter their personal details again when placing future orders.

The Customer may delete their Account at any time free of charge by sending a request to:

By clicking the "Buy and Pay" button (or another button with equivalent wording), the Customer:

  • submits an offer to purchase the selected Goods and/or Digital Products in accordance with these Terms and the selected order options; and
  • acknowledges the obligation to pay the purchase price together with any applicable delivery charges.

The sales agreement and/or the agreement for the supply of digital content or digital services (the "Agreement") is concluded when the Seller accepts the Customer's order. Acceptance is confirmed by email.

If the Seller is unable to fulfil all or part of an order, the Customer will be informed accordingly. In such a case, no Agreement is concluded with respect to the unavailable Goods. The Seller will also inform the Customer of any available alternatives, such as partial fulfilment or waiting until the Goods become available again.

If payment has already been made for unavailable Goods, the Seller will promptly refund the Customer in the appropriate amount.

The Seller will provide the Customer with confirmation of the concluded Agreement on a durable medium no later than the delivery of the Goods or Digital Product.

The Store shall not be liable for failed deliveries or delivery delays resulting from the Customer providing an incomplete or incorrect delivery address or failing to provide other information necessary to process the order.

The Seller reserves the right to suspend the processing of an order if the Customer provides false information or if the provided information gives rise to justified doubts regarding its accuracy. Where possible, the Seller will contact the Customer to verify the information before taking further action.


Prices and Payment Methods

The prices of the Goods and/or Digital Products are displayed in Polish Złoty (PLN).

Delivery costs for Goods are calculated separately and displayed during the checkout process, depending on the delivery method selected by the Customer.

Digital Products are delivered electronically and are not subject to additional delivery charges.

The payment methods accepted by the Store are described on the "Payment Methods" page and are also displayed during the checkout process.

Online payments are processed by the following payment service providers:

  • Shopify Payments
  • PayPal

Delivery of Goods

The Seller dispatches Goods within up to 10 business days, unless a different delivery timeframe is expressly stated in the product description at the time the Customer places the order.


Delivery of Digital Products

Unless otherwise provided in the Agreement, the supply of a Digital Product is completed without undue delay by electronic means. The Seller will send the Customer, to the email address provided during the purchase process, the information required to access the purchased Digital Product, such as download instructions or login credentials for the relevant account.

Access to certain Digital Products may require the creation of a Customer account on a dedicated platform used for providing digital content. Such an account is created free of charge. The technical requirements for accessing the platform are the same as those required for using the Store.

The period during which the Customer will have access to a Digital Product (for example, one year) is always specified in the product description before the purchase is completed.

Where a Digital Product is accessed through a dedicated platform, the Customer undertakes to use the platform in compliance with applicable law and, in particular, not to upload, transmit or otherwise make available any unlawful content through the platform.

The Customer is obliged to respect the intellectual property rights held by the Seller and/or the author of the Digital Products. Unless the Seller expressly states otherwise, the Customer is entitled to use the purchased Digital Products solely for their own personal use and only in accordance with the purpose for which they were supplied under the Agreement.

Without the Seller's prior written consent, the Customer may not reproduce, distribute, publish, resell, share, sublicense, or otherwise make the purchased Digital Products available to third parties.

The Seller is under no obligation to provide updates to a Digital Product unless such updates are expressly stated in the product description or in information published by the Seller in the Store and made available to the Customer at the time of purchase.


Right of Withdrawal

A Customer who is a consumer or a privileged entrepreneur within the meaning of Article 7aa of the Polish Consumer Rights Act (hereinafter referred to as a "Privileged Entrepreneur") has the statutory right to withdraw from the sales agreement for Goods within 14 days of receiving them, without giving any reason, subject to the exceptions set out below.

A Customer who is a consumer or a Privileged Entrepreneur also has the right to withdraw from an agreement for the supply of a Digital Product within 14 days of concluding the Agreement, without giving any reason, unless all of the following conditions have been met:

  • the Seller has fully performed the service or commenced supplying the digital content with the Customer's prior express consent;
  • before the performance began, the Customer was informed that they would lose their right of withdrawal once the service had been fully performed or the digital content had begun to be supplied;
  • the Seller provided the Customer, on a durable medium, with confirmation of the Agreement together with confirmation of the Customer's consent to receive the digital content under circumstances resulting in the loss of the right of withdrawal.

To exercise the right of withdrawal within the statutory period, it is sufficient for the Customer to send a notice of withdrawal before the expiry of the applicable deadline:

The Customer may use the model withdrawal form available on the Store's website; however, its use is not mandatory.

The Seller will promptly acknowledge receipt of the withdrawal notice by email.

Within the following 14 days, the Customer should return the Goods, at their own expense, to:

The Seller shall reimburse the Customer without undue delay and no later than 14 days after receiving the notice of withdrawal for:

  • the purchase price of the Goods; and
  • the cost of the original delivery, up to the cost of the least expensive standard delivery method offered by the Store.

The Seller may withhold reimbursement until the returned Goods have been received or until the Customer provides evidence that the Goods have been returned, whichever occurs first.

Unless the Customer expressly agrees otherwise, the refund will be made using the same payment method that was used for the original transaction.

The Customer is liable for any diminished value of the returned Goods resulting from handling them in a manner beyond what is necessary to establish their nature, characteristics, and functioning.


 

Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to contracts for the supply of:

  • non-prefabricated goods manufactured according to the consumer's or Privileged Entrepreneur's specifications or clearly personalized to meet their individual requirements;
  • goods liable to deteriorate or expire rapidly;
  • sealed goods that are not suitable for return after opening due to health protection or hygiene reasons, if the seal has been broken after delivery;
  • sealed audio recordings, video recordings, or computer software supplied on a tangible medium (such as a CD or DVD), where the seal has been broken after delivery;
  • goods which, by their nature, become inseparably mixed with other goods after delivery (for example, building materials that have been used);
  • newspapers, periodicals, or magazines, except where supplied under a subscription agreement;
  • goods whose price depends on fluctuations in the financial market beyond the Seller's control and which may occur before the withdrawal period expires;
  • alcoholic beverages whose price was agreed upon at the time the sales agreement was concluded, whose delivery may take place only after 30 days, and whose value depends on market fluctuations beyond the Seller's control.

Complaints

The Seller is obliged to provide Goods and Digital Products that conform to the Agreement.

With respect to consumers and Privileged Entrepreneurs, the Seller is liable for the conformity of the Goods and Digital Products with the Agreement in accordance with the provisions of the Polish Consumer Rights Act.

With respect to all other Customers, the Seller's liability is governed by the provisions of the Polish Civil Code.

The Seller will respond to the complaint in the same form in which it was submitted (in writing or by email) within 14 days of its receipt.

If the Customer is dissatisfied with the outcome of the complaint procedure, consumers and Privileged Entrepreneurs may, in addition to pursuing claims before a competent court, make use of alternative dispute resolution procedures.

The Customer may, in particular:

  • apply to the Provincial Inspector of the Trade Inspection Authority to initiate mediation proceedings aimed at reaching an amicable settlement;
  • seek assistance from a District (Municipal) Consumer Ombudsman or a consumer protection organization;
  • use the Online Dispute Resolution (ODR) Platform, which facilitates the online resolution of disputes between consumers and traders arising from online contracts;
  • submit the dispute to a permanent consumer arbitration court.

Rules for the Use, Display and Storage of Products

The Products offered in the Store, including in particular art reproductions, fine art prints, and framed Products, are decorative items intended for indoor display and storage under conditions appropriate for this type of product.

The Customer shall use, display, and store the Products in accordance with their characteristics, the Product description, and any care and storage instructions provided by the Seller, including, in particular:

  • keeping the Products away from direct sunlight and intense UV radiation;
  • protecting them from moisture, water, steam, and areas of high humidity (recommended relative humidity: 40%–60%);
  • keeping them away from sources of heat, cold, and sudden temperature changes;
  • protecting them from dirt, creasing, abrasion, pressure, chemicals, and other forms of mechanical damage.

Framed Products should always be displayed with the protective glazing or covering intended for the specific frame. Unframed prints should be stored in a manner that protects them against moisture, deformation, folding, improper rolling, and damage to the printed surface.

Due to the properties of the materials used in the manufacture of the Products—including fine art papers, archival inks, framing materials, mat boards, glass, acrylic glazing, and other protective components—prolonged exposure to the conditions described above may result in fading, discoloration, warping, staining, mould, deformation, or other aesthetic or functional changes.

The Seller shall not be liable for damage, deterioration, visual changes, or loss of functionality occurring after the Product has been delivered to the Customer where such damage results from improper use, display, installation, transportation after delivery, or storage contrary to these Terms, the Product description, or the care instructions provided by the Seller.

Any changes or damage arising from the circumstances described above shall not, in themselves, constitute a lack of conformity of the Goods with the Agreement, provided that the Product complied with the Agreement at the time of delivery.

Nothing in this section excludes or limits any statutory rights granted to consumers or Privileged Entrepreneurs under mandatory provisions of applicable law.

When investigating a complaint, the Seller may request that the Customer provide photographs of the Product together with a description of how it has been used, displayed, and stored, but only to the extent necessary to determine the cause of the reported damage or deterioration.


Final Provisions

These Terms and any Agreements concluded through the Store shall be governed by the laws of the Republic of Poland.

The Agreement is concluded in the Polish language.

Nothing in these Terms excludes or limits any rights granted to consumers or Privileged Entrepreneurs under mandatory provisions of applicable law.

The Seller reserves the right to amend these Terms at any time. Any amendments shall apply only to orders placed after the updated version has been published.

In the case of:

  • agreements for the supply of digital services or electronic services concluded before the amendments; or
  • Customers holding a Store account,

the Customer will be informed of the amendments and of their right not to accept the revised Terms where required by applicable law.

These Terms enter into force on 2 January 2025.
